In these terms and conditions, “we/us" means ‘Rock Travel Limited’ (Jersey registered business number 128787) and “event” mean’s any holiday, accommodation, activity or function organised or advertised by us. "You" means the person who has signed the booking form and includes all the people on whose behalf you have signed. "Supplier" means the company or person that is holding or providing the event or any part of it. "Price" means the total cost of the event.

1. Terms and Conditions

 

These terms and conditions for the basis of the contract between you and us to the exclusion of all other terms and conditions save for those implied by law, and no variation to these terms and conditions shall be valid unless in writing and signed by both parties. It is important you are aware of the conditions together with the information we send out in connection with your tour. These conditions not only set out important commitments by us but also our obligations to our customers. You shall be deemed to have accepted these Terms and Conditions from and with effect from the earlier of the date upon which these Terms and Conditions are first brought to your attention and/or the commencement of the arrangement of an event by Rock Travel.

 

2. Formation of Contract

No contract shall arise between you and us until we have received the deposit payable and we have sent to you written confirmation (this can be in the form of an email) of our acceptance of your booking.

3. Lead Name

The lead name on any booking with us accepts the full responsibility of collecting the full balance payable for the booking and indemnifies Rock Travel against any loss from any individual failing to pay within your group. The lead name of the group is also responsible for ensuring that all group members are aware they are bound by our terms and conditions. The lead name is also responsible for the completion of the online guest list on behalf of all persons on the booking. It is understood that those booking via email or telephone agree to, and accept our terms and conditions. 

4. Payment & Deposits

 

Deposits are payable at the time of booking and the balance of payments are split into the following phases: 

 

i) An agreed non-refundable non-transferable deposit is payable at the time of booking (amount is dependent on tour)

 

ii) The final balance is to be paid no less than 56 Days (eight weeks) before the date upon which your event is due to start. 

For your own protection and financial security of monies paid, your tour will be fully insured by Protected Trust Services cover. This means that in the unlikely event of Rock Travel ceasing trading your money will be refunded to you. 

As a member of Protected Trust Services (PTS) you are always secure in the knowledge that your money is safe. All funds you pay for a tour with Rock Sports Travel get paid directly to the PTS trust account. The funds are administered by a firm of chartered accountants and paid directly to the suppliers. This ensures that should anything happen to Rock Sports Travel, your money and your tour are safe.

Your financial security is further enhanced by our supplier failure insurance. All bookings administered through PTS automatically include additional insurance, covering each element of your tour. 
 

5. Cancellation by Us 

 

We may cancel your tour or activities or any part of the tour 

 

  • for safety reasons if we or our supplier(s) regard adverse weather conditions or other safety concerns as unacceptable and which cannot reasonably be overcome;

  • If we reasonably believe that you may cause harm or damage to our reputation or to the reputation of our suppliers or to property belonging to our suppliers;

  • If a supplier or suppliers are unable to host the event for any reason;

  • If changes you wish to make to the booking mean it is uneconomical or impractical to hold the tour.

 

If we cancel the whole of the tour we shall use our best endeavors to rearrange the tour on a mutually convenient date or provide a refund to you of the cost to us of the tour. Save as above, we shall be under no further liability to you for cancellation of the tour or any part of it.

 

6. Cancellation by You

 

You, or any member of your party, may cancel your travel arrangements at any time. Written notification from the person who made the booking must be received by us. Since we incur costs in cancelling your travel arrangements, you will have to pay the applicable cancellation charges up to the maximum shown below.

Period before departure within which written cancellation is received by Rock Travel and amount of cancellation charges shown as a percentage of the booking price.

More than 98 days   =     deposit 
98-72 days               =      30% or deposit if greater
71-42 days               =      50% or deposit if greater
41-22 days               =      75% or deposit if greater
21-15 days               =      90% or deposit if greater
14 days or less        =      100%

7. Accommodation

 

Rock Travel will not accept liability for theft, loss or damage of any nature during your tour or resulting from a stay at any accommodation. We are also not liable for the breakdown or non-operation of technical equipment and the cancellation or closing of facilities at your choice of accommodation. It is very important that the accommodation is left in a clean, tidy and undamaged condition otherwise you will be liable either for any loss of contents, cost of repairs.

 

9. Meals

 

Restaurant meals may require a pre-order to be completed by the lead name of the group. This should be completed and returned to us, or the venue as required. If a pre-order has not been completed, we accept no liability for meals not provided or delays in providing the meals for you. You will not automatically be sent any menus and menus may be of limited choice from a set-menu for groups. We will endeavour to meet any specialist dietary requests for any member of your group, but cannot guarantee these requests. We accept no liability if our suppliers are unable to meet these requests in advance, or once at the venue. If your group arrives late then we accept no liability.

 

10.  Excursions and Activities

Excursions or other tours that you may choose to book or pay for whilst you are on holiday are not part of your package holiday provided by us. For any excursion or other tour that you book, your contract will be with the operator of the excursion or tour and not with us. We are not responsible for the provision of the excursion or tour or for anything that happens during the course of its provision by the operator.

11. Alterations by Us

 

The arrangements for tours are made many months in advance, and whilst it is unlikely it is sometimes necessary to make changes. If a major change becomes necessary we will tell you as soon as possible before your departure, and (except where the major change arises due to force majeure) you will then have the choice of accepting the change, taking an alternative tour (where this is of lower cost we will refund the difference in price, but where it is a higher price you must pay the difference), or withdrawing from the contract and accepting a full refund. Any other change is a minor change. We may make minor changes at any time, and although we will if possible advise you of any such change before your departure, we are not obliged to do so or pay compensation.

 

“Force Majeure” means any event which we could not, even with all due care, foresee or avoid. Force Majeure covers events such as, but not limited to, technical or maintenance problems with transport, changes imposed by rescheduling or cancellation of flights by an airline or main charterer, the alteration of the airline or aircraft type war or threat of war, riot, civil strife, terrorist activity, natural disaster, industrial dispute, disease, industrial or nuclear disaster, bad weather, fire, cancellation of sporting fixtures or a featured tournament and all similar events beyond our control. In the case of Force Majeure we will not accept liability & reserve the right to cancel or change bookings as necessary

12. Alterations made by You

 

We shall try to accommodate any reasonable changes you wish to make to the tour. Alterations and amendment requests should be made in writing by the lead name to Rock Travel and not to our individual suppliers. These changes shall not be deemed accepted until we have confirmed in writing to you. If you wish to increase or decrease the number of persons participating in the event  you may do this up to six weeks prior to the date upon which your event is due to start. Changes such as arrival / departure dates and destination changes will  be subject to our administration charges. We cannot guarantee that the change to the price will be pro-rata, but will depend upon the arrangements we are able to make with our suppliers. You may transfer your booking to a person who satisfies all the conditions applicable to the event. 

13. Your Obligations

 

You shall always behave in a safe, responsible and courteous manner; comply with all instructions, regulations and codes of practice issued by us or our suppliers, ensure that you comply with all age restrictions imposed by our suppliers, ensure that you comply with all arrival times, and dress appropriately for the event. If you breach these obligations we may cancel or curtail the event or any part of it and in those circumstances you shall not be entitled to any refund. You shall take out insurance suitable for your needs (including delays for events involving travel by land, sea, or air) before the event. 

 

If, in the reasonable opinion of our representative/escort/tour manager, your behaviour or the behaviour of anyone in your touring party is such that it is likely to cause distress, damage, danger or annoyance to our customers, employees, property or to any third party, we reserve the right to terminate all arrangements immediately without refund.

 

As a condition of booking you are required to take out adequate travel insurance for yourself and those for whom you are booking. This needs to include cover for sports injuries for sports participants. It is a condition of us accepting your booking that you have made adequate insurance provision to cover your party. 

 

14. Our Obligations

 

All of your fixtures will have been personally arranged by Rock Travel. We will attempt to match teams of equal ability and age group based on the information provided and contact with the opposing team. However, we cannot be held responsible for any fixtures cancelled due to bad weather or for any other unforeseeable circumstances. In the event of games being cancelled we will endeavour to arrange alternative fixtures for you or organise an excursion. Rock Travel applies all reasonable checks to ensure that those involved in the preparation and provision of your tour maintain the appropriate standards. Rock Travel shall not accept responsibility or liability for death or bodily injury, caused to the signatory of the Booking and/or any other person in the group, unless caused by the negligence of our employees whilst acting within the scope of their employment. Many of the services which make up your tour are provided by independent suppliers.  Those suppliers provide these services in accordance with their own terms and conditions which will form part of your contract with us. Some of these terms and conditions may limit or exclude the supplier's liability to you, usually in accordance with applicable International Conventions. Copies of the relevant parts of these terms and conditions are available on request from ourselves or the supplier concerned.

15. Customer Feedback

 

If you have a problem in respect of your booking, in the first instance you should bring this to the attention of the relevant person(s) at the earliest opportunity (e.g. the hotel manager / restaurant manager) and secondly our local agent and every effort will be made to achieve a satisfactory solution. However, unless there is a valid reason why you did not report your problem to the appropriate person(s), we will not consider ourselves liable for those complaints. If they are unable to resolve matters to your satisfaction then you must write to us within 7 days of the conclusion of the tour. No complaint will be accepted outside of this time frame thus deeming you fully satisfied with all aspects of the tour and the services we have provided to you. We will acknowledge any correspondence within 5 working days and endeavour to deal with the complaint as quickly as possible.

16. Jurisdiction

 

This agreement shall be construed in accordance with the laws of Jersey and the courts of Jersey shall have exclusive jurisdiction to deal with any disputes arising between you and us or our suppliers.

17. Data Protection 

In order to arrange your tour we are required to collect, process and share certain information relating to you and your group including (but not limited to) your name, passport details, address and any dietary requirements with suppliers of your travel arrangements such as hotels, tournament organisers and transport companies. Where we are required by law to collect your personal data or we require your personal data under the terms of a contract or a contract we are entering into with you and you do not supply that information to us, we may not be able to perform the contract we have or are trying to enter into with you (i.e. the tour that we are arranging for you) and we may have to cancel the tour. We will of course notify you if this is the case. We shall act in accordance with the requirements of the Data Protection (Jersey) Law 2018 and any other relevant data protection laws to the extent that they apply in respect of our activities. Rock Travel apply appropriate security measures to protect your personal data and we will only process your personal data to the extent required in order to provide you with our services. 18. Changes to these Terms and Conditions

These Terms and Conditions may be varied from time to time by publishing the varied Terms and Conditions on our website. On the basis of such publication, you shall be deemed to have agreed to these Terms and Conditions and all such variations. These Terms and Conditions supersede and replace all and any terms of business previously in force in relation to the arrangement of any event.
